These General Terms and Conditions (GTC) apply to all orders that a customer (hereinafter “customer”) places with the provider, unless otherwise agreed in writing.
2. Type of service and contractual partner
The provider provides procurement, consolidation, packaging and shipping services on behalf of the customer. The provider acts as a commissioned buyer and shipping service provider, not as a seller of the purchased goods.
The goods selected by the customer are procured exclusively in the name and for the account of the customer. The underlying purchase contract between the customer and the original seller (online shop, market seller or manufacturer) remains economically and legally attributable to the customer.
The provider’s services include in particular:
- Advice when shopping in Indonesian online shops or local markets
- Procurement of the goods requested by the customer after the order has been placed and payment has been made in full
- Intermediate storage, consolidation and packaging
- Shipping preparation and processing via international shipping service providers
3. Conclusion of contract
A contract between the customer and the provider is concluded through written or electronic acceptance of an offer from the provider. The provision of a cost estimate by the provider is non-binding unless it expressly declares a binding offer.
A mutual service contract is created between the parties. The provider undertakes to properly provide the procurement, packaging and shipping services agreed in the order. There is no work character (promise of success for procurement or customs or delivery success); However, the provider is liable for careful selection of the precursors and proper execution of the agreed activity.
The actual procurement of goods only begins after receipt of full payment of the total amount communicated by the provider.
4. Prices and Payment
All prices will be communicated individually before the order is placed. They consist of the costs of the goods purchased, the procurement commission, packaging, shipping costs and, if necessary, other additional services requested by the customer. Unless expressly agreed otherwise, the prices quoted by the provider do not include customs duties, import sales tax or other public fees in the recipient country.
Payment options:
- Bank transfer to Indonesia
- PayPal (plus the respective PayPal fees)
- Wise
- For business customers in the EU with a valid VAT ID: transfer to the provider’s EU account
The order will only be executed after receipt of payment. If the actual purchase price, packaging or shipping price changes after the order has been placed due to circumstances for which the provider is not responsible (e.g. price change by the seller, weight deviation, special packaging, new shipping costs), the provider will inform the customer of the new costs. The customer can object to the change within three working days; otherwise the change is deemed approved.
5. Customs, import regulations and legal regulations
The customer is solely responsible for ensuring that the goods he has ordered can be imported into his destination country and that he complies with applicable customs, import, tax, veterinary, food, drug, environmental and other government regulations.
Costs such as customs duties, import sales tax, inspection and presentation fees, storage costs at customs and any return or disposal costs are borne by the customer. Upon request, the provider will inform the customer about general experiences with import regulations, but does not assume any legal liability for their accuracy or completeness.
The provider is not liable for customs delays, rejection, seizure, return or destruction of goods by customs or other authorities. If the customer instructs the provider to procure goods whose import into the destination country is prohibited or restricted, the customer must reimburse the provider for all resulting costs, fees and damages.
6. Shipping, Insurance, Loss and Damage
Shipping is carried out via external, international shipping service providers (e.g. PosIndonesia, DHL, EMS, FedEx or courier and freight services). The choice of shipping service provider is the responsibility of the provider, unless otherwise agreed.
The risk of accidental loss and accidental deterioration of the shipment passes to the customer as soon as the shipment is handed over to the shipping service provider for transport. This also applies if shipping is carried out using a third party commissioned by the customer.
If agreed, shipments will be insured against the value of the goods communicated by the customer. The scope and amount of the insurance benefit depend on the conditions of the respective shipping service provider. When the shipment is handed over to the shipping service provider, the customer receives a tracking number.
In the event of damage (loss, damage or obvious reduction), the customer is obliged to submit photographic evidence and a written report of the damage immediately, but no later than seven days after delivery or after the expected delivery date. As part of the agreed service, the provider will report the damage to the shipping service provider. Compensation will only be made within the scope of the insurance conditions of the shipping service provider and, if paid by the shipping service provider, will be passed on to the customer.
7. Delivery times
Delivery times depend on the procurement time, the shipping method chosen, customs processing in the destination country, the weather, pandemics, strikes and other circumstances that cannot be controlled by the provider. All delivery times are therefore non-binding guidelines and not binding delivery dates, unless the provider has expressly promised a fixed delivery date in writing.
If there are delays for which the provider is not responsible (in particular force majeure, customs delays, strikes, pandemics, delays by the seller or the shipping service provider), the agreed delivery times will be extended accordingly.
8. Right of withdrawal and early execution
If the customer is a consumer within the meaning of § 13 BGB, he is generally entitled to a right of withdrawal in accordance with § 355 BGB. A sample cancellation policy can be found on the website.
In the case of a contract for the provision of services, the right of withdrawal pursuant to Section 356 Paragraph 5 No. 2 of the German Civil Code (BGB) expires with the complete provision of the service if the provider has begun execution before the end of the withdrawal period after the customer has given his express consent to this and at the same time confirmed that he knows that his right of withdrawal expires upon complete fulfillment of the contract.
If the service was started with the customer’s express consent before the end of the cancellation period but has not yet been fully provided, the customer can cancel; However, the provider is then entitled in accordance with Section 357a Paragraph 2 BGB to demand compensation for the services already provided. The compensation depends on the ratio of the services already provided to the total service.
9. Withdrawal and cancellation after procurement has already taken place
As soon as the provider has procured the goods desired by the customer, it is generally not possible for the customer to withdraw from the order or cancel the purchased goods. In this case, the customer bears the costs already incurred for procurement, packaging and shipping preparation as well as an appropriate procurement commission.
Procured goods that are not further dispatched by the customer can be stored by the provider for the customer’s account or – if legally and economically reasonable – used. The customer remains obliged to pay the agreed remuneration.
10. Liability
The provider is liable for damages resulting from intentional or grossly negligent behavior. Liability for simple negligence is limited to the violation of essential contractual obligations (cardinal obligations) and its amount is limited to the typical, foreseeable contractual damage.
There is no liability for:
- Quality or functional defects in the goods selected by the customer
- Delays or damage caused by customs or shipping service providers
- Incorrect or incomplete customer information (e.g. address, customs or product data)
- Damage caused by the customer through improper use, storage or further processing of the goods
The above liability limitations do not apply to damages resulting from injury to life, body or health, to the extent required by law.
The provider does not check the authenticity, quality, function or brand conformity of the products selected by the customer. The warranty obligations from the purchase contract with the original seller remain unaffected; However, they do not affect the provider.
11. Warranty and responsibility for products
The provider is not the seller of the purchased goods. Warranty claims due to material or legal defects are directed exclusively against the original seller in Indonesia. The provider will support the customer to the best of its ability in enforcing such claims, but does not assume any liability for this.
The provider undertakes to procure the goods specified by the customer in the quantity and version ordered, to pack them carefully and to hand them over to the agreed shipping service provider. This does not constitute a promise of quality about the products themselves.
12. Data Protection
The data protection declaration published on the website applies. Personal data is only processed to process the order, communicate with the customer and fulfill legal obligations.
Since the services are provided in Indonesia, data may be transferred to a third country (Indonesia). The data protection declaration contains further information on recipients, legal bases and rights of those affected.
If the customer is a consumer, the mandatory information in accordance with Articles 13 and 14 GDPR will be provided in the data protection declaration.
13. Applicable Law and Place of Jurisdiction
German law applies to the contractual relationships. For consumers, the mandatory consumer protection regulations of the country in which the consumer has his or her habitual residence apply, provided that these take precedence over German law.
To the extent permitted by law, the place of jurisdiction is the registered office of the provider. For consumers, legal action can also be brought at the consumer’s place of residence. The EU account is only used for more convenient payment processing; it does not establish an establishment in the sense of an additional place of jurisdiction.
14. Severability clause
Should a provision of these General Terms and Conditions be or become wholly or partially ineffective, the effectiveness of the remaining provisions remains unaffected. If agreed, the invalid provision will be replaced by an effective regulation that comes as close as possible to the economic purpose of the invalid provision.
